No need to litigate (or even disagree about) what is settled or in process of settling.

Defendants either have settled or want to settle, so it looks like you were wrong on this one.

The question was about the waterfall and what % of the settlement shareholders should get. No need to get philosophical about whether there should actually be a settlement or not....
