This is probably an unpopular opinion.

We do not know why Amarin chose Nevada, but I don't think that choosing it was their most egregious act.

If the venue was chosen because of its proximity to where Kennedy lives, then I wish the worst possible thing for him. But I just don't think that is the reason why. If I had to guess, I would say that it had something to do with Nevada state's patent laws favoring patent holders (yes the case is federal but I believe that local laws matter too).

Also, judges get assigned randomly, via a lottery like system. So there was no way for Amarin to know that Du would be chosen. Do we know that there weren't a bunch of pro patent judges in that district and we got unlucky (just like in the appellate court) with drawing Du?

Likewise, do we know that there weren't a bunch of anti patent judges in New Jersey or Delaware?

I am not making excuses and saying that Nevada was the correct choice. I am saying, however that we do not know why Nevada was chosen (IR owes us the answer) and it is possible that it may have been the correct choice with the information they had at that time.

I still vehemently believe that their legal team blew the case. Inexcusable for them not to have done the statistical analysis that Dr Bhatt did.
