PickStocks.....you are off point....this issue is not about DMDMD at all.. he found something that was not properly litigated in court, years after, and brought it to the attention of posters on the message board....Alice being a lawyer, picked up on it, and sought to get a proper ruling from the judge as to how it affected the claims payoffs... nothing more, nothing less...why didn't the judge, after Alice stood before her in the courtroom, and making that now famous statement that I would have ruled on it anyway, write a brief explain why she would do so?...that would have cleared up the matter , once and for all, and if her decision was fair by the POR 7, then that would have been the end of it, and Alice would not have to go back and forth to court for an answer... As I see it, the judge is at fault here for not being explicit in her ruling deny Alice her motion...also, if the judge made a mistake here, in not providing sufficient evidence of her decision, there could be a disruption in the bk closing...If not Alice, some other smart attorney will pick this up and continue to "carry the torch" for equitable outcome to all parties and claimants...no stone goes unturned in a courtroom, there are just too many eyes following this chapter 11...its too bad that Sussman past away... he would be turning in his grave now when he finds out the final outcome to come shortly....lodas
