That's the reality and why we are where we're at now. SCOTUS "choses" to hear cases based on constitutional merits. They would have done a simple remand to the Enbank court and let things be settled there if they thought this did not have important enough implications that they needed to step in and rectify a congressional cluster-fuk of a law.

Arguing that the law they wrote, which included their verbage about no judicial review, is laughable to them, I bet. Congress trying to insulate their laws and plans from the other two branches of our goverment is a treasonus subversion and bastardization of the basic constitution.

Scotus needs to spank the crap out of this to make sure those creating the laws are more mindful and in line with our constitution instead of always trying to find ways to skirt around it.
