You nailed it, alm. Exactly what I am thinking. I do not want to get too far ahead of ourselves given the utter lack of fairness and objectivity demonstrated thus far in the adjudication of this case, but if there was a remand from the Federal Circuit, prudence would dictate at least consideration of a motion to disqualify based upon the appearance of impropriety. Not actual impropriety, but the appearance thereof (bias).
