Not to split hairs but I re-read his statement and it didn't say "no settlement talks" - it said "no settlement any day soon." There is quite a difference in those statements. It is likely that all of the parties have engaged in settlement talks but have failed to arrive at an agreement with WDDD. The infringers make low-ball offers hoping WDDD will take it. So far they haven't.

If the settlement with Linden Labs comes to fruition, then obviously the statement "no settlement any day soon," would be incorrect. It seems like they will reach a settlement agreement but it hasn't happened yet.
