Count--Perhaps your experience in practicing law is different from mine, but the minor delay that Nokia achieved by requiring a retaking of the deposition is outweighed by having sanctions levied against them. When legal fees are assessed in a case like this, it leaves a bad taste in the mouth of the Special Master and the judge in evaluating counsel's future actions. And for those who have indicated that the Special Master should have ordered the sanction of dismissing Nokia's case, my experience under the federal rules of civil procedure would be that such a sanction would have been too severe under the circumstances and would have been reversed by the judge or on appeal, thereby prolonging the case further.
