In my opinion your perspective on this is somewhat off. That may be what WDDD wants but that doesn't mean they get that. They will not get a settlement amount for infringement and an additional amount for attorney fees. The offers presented will be one amount. Why would ATVI pay for legal fees in a settlement when in most cases they wouldn't have to even after a trial win? A settlement is a compromise and would be significantly less than what is expected at a trial win. If WDDD insists on additional fees to cover legal expenses, as you suggested, the settlement discussion would end and it would result in a trial. A company will not pay additional fees in a settlement that wouldn't ordinarily be included with a trial win.

People posting about attorney fees being paid by ATVI is simply misinformation or wishful thinking. It just doesn't work like that.
