The units are supposed to be capable of matching a cover band playing songs to the original artist as I have understood it. If that is the case, it would stand to reason he has to make such a disclaimer. Perhaps the mix of instruments used, room acoustics, etc etc are such that a match would be nearly impossible (think eccentric performances for example like someone playing PVC pipes as an instrument)...

If he is saying accuracy is near 100%, that sounds like it is market-ready. Making a disclaimer like that just sounds like standard fodder to avoid a lawsuit should the system have an occasional miss.

all my opinion of course...
