What is your vision on how a judge responds to these Rule 60s? Human nature says that anyone involved with making a decision that requires alot of time, procedures, thought, and writing does not take lightly to being accused of being wrong.
First instinct is to protect that decision. Say, ah yes perhaps the wrong evidence is not really all that made me decide this way.
Second instinct is to say, why did you not bring this to my attention earlier, I wasted all this time and effort, and now you are trying to make me look at it again? Get out of here!
Third, not an instinct, but a thought mixed with emotion. I am outraged by the party that presented this false evidence because it makes me look stupid, makes me look incompetent. I will throw down hammer and reverse my decision.
What percentage of Rule 60s succeed? And did you find any examples of the judges reactions you want to share.
Thanks
