The Commission doesn't have to "file" anything to do with the brief.

Enforcement was required to file their brief on the 24th. The Commission is not required to file anything to do with the brief. They only receive it.

They CAN if they WANT.

But they DIDN'T.

Doesn't mean the brief wasn't filed.

Is the Board required to PROMPTLY FILE any changes to the ID of an ALJ? Yes they ARE. That info is right in the SEC Website.

Do you SEE any new filings pertaining to the Foelak ID? NO, you don't.

8 days has gone by since the deadline for Enforcements filing. If they hadn't filed, do you believe that the Board would have "dismissed the review" and finalized the ID by now?

Some certainly do!

Does it say in the SEC Website that the Board PROMPTLY posts any changes to the ruling of an ALJ ID to the Administrative Proceedings Page? Why, YES. It Does!

DO you see any such postings to the Proceedings page?

Nope!

For myself, I think it's obvious that the Board has received the Enforcement filing and is now awaiting the response filing from DBMM.

I keep telling myself....deep breath....count to ten....try to answer without personal attack...if available, always try to present fact to back up your opinion.
