Call of Duty has generated $27 billion in revenue for Activision since it's inception in 2003. When did Call of Duty first infringe on Worlds' patents? Since 2003? How critical or how big of a role of Worlds' patents had on Call of Duty? If Worlds' patents have played very important role, then the Court can award a royalty rate bigger than the norm.
But let's put a fair royalty rate of 5%. You do the math. And if 3X punitive damage for willful infringement is applied, then what is $27,000,000,000 x 5% x 3? (don't forget to take out the lawyer fees)
