alm, as always you raise insightful points. I am not going to speculate why Amarin has not taken up the Rule 60 gauntlet. For whatever reason, their legal team has decided not to do so.

Our filing will not be critiquing or bad-mouthing Amarin. At this point, I just do not want them to obstruct or oppose the effort, and even post-filing, any support from Amarin is most appreciated.

In terms of entering discourse, our very own eightisenough, sent a formal demand letter back in November, requesting that Amarin file the Rule 60. To the best of my knowledge, Amarin never responded. That letter will be attached in support of our corresponding Rule 24 Motion to Intervene.
