Burba does not submit a patent with the "brine" break down. The Brine looks to be a secretive as the "special sauce" on the Big Mac(McDonalds).
That opens the door for the equipment to be whatever, however. A watch is a watch, it is the gears and mechanisms that differentiates one watch from another.
How is the process executed, and I don't think there will be an issue here, since the "brine" is the secret sauce. The equipment carries out the process in a different fashion(watch internals).
The argument, I would have, TERRALITHIUM LLC. mentions nothing in the BACKGROUND and the SUMMARY OF THE INVENTION, on the extraction of Lithium(correct me if I am wrong). Covers the mention of it in the Technical Field of the invention. But the Terralithium patent is to vague(although very detailed in the process of extraction) around the intentions of patent and Lithium processing and handling. TERRALITHIUM's patent intentions are around "scale buildup", not "harvesting".
How I am reading the differences between these two.
I can patent a piece of paper folded in half, with weight, dimensions and intentions to be PLACED on the table.
The next person can come along and patent a piece of paper folded in half, with weight(slightly different than mine), dimensions(slightly off from mine) and the intentions are to HOLD the table down.
I love how TERRALITHIUM submitted two different version from the original version varying in solution amounts, ha. Trying to close in on Burbas "secret sauce".
