Wrong. The complaint was merely digitally signed and digitally filed by ATTORNEY David A. Jenkins of the LAW FIRM then representing Nikola. NO Affidavit is attached attesting to the truthfulness of the allegations made in the Complaint. The only standard is that of legal ethics: That the attorney does not have an independent reason to believe that the allegations made therein are facially fraudulent. Where does he obtain the alleged "facts" that are recited in the Complaint? From his client. Who was his client? Management of Nikola. Do we have substantial reason to question the veracity and motivations of Nikola in connection with that particular business relationship (or lack thereof)? Absolutely. Nikola CEO unceremoniously resigned shortly thereafter due to very questionable and dishonest behavior on his part. And THAT is whose "word" upon which that Complaint was based. Thus, in a word, the Complaint was based on "horsesh!t." Add to that the fact that Nikola was trying to shrewdly position itself such that it could essentially steal the ZapGo's IP for a song ($56 million), and what do you have? Exactly what everyone saw transpire.
