I am speculating that posting on a public investment forum, without identifying oneself as a company insider or spokesperson, is at the very least an SEC Reg FD violation. A standalone Reg FD violation would be a civil matter.
OTOH, if the posts included serious misrepresentations by the "spokesperson", i.e. CEO Keith Berman, the associated violations could be construed as securities fraud. Securities fraud is a criminal matter. Berman's grand jury criminal indictment seems to focus on the PR's, but the following was included in the criminal indictment:

Either way, the SEC does not look kindly on company affiliates or "paid consultants", who hide behind an alias to communicate on public forums or chat rooms.
