Sorry Jimmy, I actually have worked with people who have much more money to invest, and while I agree she should not put something like that in a small article like that if she doesn’t know fir sure, is a reasonable assumption. But the idea that she knows and consulted counsel that actually knows that is true in this case, is absolutely not likely. Plus, a person in this situation is not going to be held liable and can get a company lawyer to defend any statement she sincerely believed at the time based upon a layman’s understanding of “the law” and her belief in the policy behind the law. She is not going to be held liable, and there will be someone who will willingly defend her right to write that... so unfortunately, the end result is she can be sloppy like that if she wants to be sloppy.

It doesn’t matter if you believe her or not. It’s not a rule and it’s unlikely they unequivocally failed for a million other reasons, plus the ambiguity that is the FDA and its procedures. The company will do what it has to do to make a reasonable announcement of TLD and all of this muddled nonsense will have been irrelevant. But don’t use that false axiom on a more questionable investment. You will surely regret it at some point, and learn the hard way.
