I would say knowingly incorporating a patent into your product and expecting to not get caught is a bit more naïve. Especially if you are a corporation of the size and visibility of Intel.
The examples you cite are generally choices of individuals, which is different than corporate policy. Individuals certainly cheat, and even some corporations as well. Yes, Bernie Madoff does exist. However, that does not refute what I originally wrote.
