“The COE decision re Pebble as “not in the public interest” will not only be applied to ANCSA lands but to all state and federal lands and will become a new tool to defuse all resource development in Alaska. Note that “public interest” is neither defined nor is there any criteria advanced for such a decision.” This is actually a legal route they could use because there is no way to prove such an ambiguity and it’s a clear overreach of their authority.
