Naked shorting is not illegal. When you open a margin account you sign a thing with the broker saying he can lend the shares out. NITE borroows most of the shares he sells.

What NITE got busted for from time to time in the past was stock manipulation. SEC fine for that was $1 mil. But NITE didn't care. He made more than that doing it. He isn't as active as he used to be.
