I'm not expert on jurisprudence, so I'm not sure that criminal is a correct word choice, but it certainly falls into a grey area of poor ethics and questionable morality. That said everyone knew it was a lottery ticket when they bought, they simply believed it was a higher than normal probability of winning lottery ticket. We have a right to be upset that so many misleading comments were made, resulting in massive losses, we've paid dearly to have the right to be angry, but I'll have to leave it to the courts to determine if criminal is the correct assessment.
