I think you are missing the point...there isn't a case...they have a year...they can play with their dicks for a year if they want. The FDA already stated they have a year. Now if they said data is good and you made an investment decision based on that and a year later they disclosed that it is bad...well then you have a case. Then evidence may show that they came to the conclusion that it was bad data after one month and played with their dicks for 11 months...and then sat on it...(sat on the data...not the dicks).
