I can site real world cases where the company did not disclose and investors were screwed. I gave you DNDN. Advectin is perhaps even more on target, they failed to disclose the FDA told them they would not approve an endpoint change. In that case, they actually had a SPA, so the FDA had to really approve the change (not just advice on it).

Yeah, these cases get litigated. And often the company loses. And after that the execs walk with millions and the investors get a check for $12.37
