If it was you or I building this mine, with all the worries about fisheries etc, what do you suppose the chances are the EPA would waive this? They would do this plus a thousand things more, and we would never make it through.

That worry about the water pollution requirements sure did its job of keeping this stalled in limbo until the right moment to proceed, didn't it? Kept people from investing in this stock, also.
