It makes perfect sense to me that almost all prescriptions will infringe, but according to HDG it doesn't matter. He stated that if there are any that do not infringe, than legally none infringe. He cited many cases to support his point. The GSK/TEVA case was the exception, but we do not know how this case will play out in appeal. In the meantime no one will buy Amarin at a fair price will all the uncertainty IMO.
