I believe that because this was in connection with a re-hearing/en banc Petition, the Motion for Leave would go first to the Panel.

The procedure for seeking leave to file an amicus, is either obtain the consent of the parties, or file a motion. An amicus does not need the endorsement of any of the parties. We hit all of the criteria on what should have been a routine, mundane issue. I think this Panel was just being petty in preparation for their rejection of the Petition.
