Not sure we can do anything about this now. Can BIO submit another amicus brief on our behalf? (I read their brief regarding the CAFC's endorsement of the "totality" vs "prima facie" framework) very good read.

Anyways, the Novo opinion conceded you go to far when you conclude "claims" as being obvious, then go on to secondary considerations. I honestly think Dyk/Prost thought It was a convenient distinction at the time, but hey they wrote it down.

So now Novo and Cyclobenzaprine are actually BOTH cases supporting ours.
