Hatch-Waxman skinny labeling opened a Pandora's box of infringement by inducemnet (quite deliberately). It was a wolf whistle to "come infringe sil vous plait"in my opinion justified by "lowering prices for the public", just to let generics provide means motive and opportunity, for others to plunder unscathed and line the generics pockets. Society and the Law must protect the companies that expend vast monies and create the critical intellectual capital that benefits everyone. Isn't that how true Incetivization of every kind works? Otherwise are we not killing the Goose that lays the Golden eggs?
