The BOD would have to be in on it (they are only 5 people one of whom is Thero) but you don't need Covington or Singer in on it just Kennedy giving them shitty instructions on how to conduct the trial... even if Kennedy told them everything they would (I think) be covered by Attorney-Client privilege.

So you only really need 6 people (Thero and Kennedy included) and probably an outside finance partner.
