If you and ziploc_1 be correct that an appellee brief before the CAFC contained a cropping “error” that was actually different from complete evidence the PTO considered below, I have pointed out before that such truncated material in that brief should be point 1 in a petition for en banc rehearing.

IMO, the scenario above is evidence of misleading, deceptive conduct on the part of appellees and their counsel that will catch all eyes at the CAFC.
