Surely he would have to do that pretty soon....Oct 28th would be too late, so I would think it would be at least 2 weeks prior to that at a minimum.

My only arguments:

1) Legal.....offering those prior roll downs establishes precedent.
2) $20 Mil should be enough, possibly not, if final data takes longer than expected.
