wwalker3, no but I am no expert on mining permits. I just did trial stuff, countless s hundreds all types under the sun basically, some of which did involved administrative boards of all types, and appeals I had to get involved in, know that area pretty well imho, wrote 104 ghost decisions as a law clerk for two guys, both of whom got on the supreme court in my state, one the chief justice (no thanks to me).. TC would know. In fact, I forget if the appeal goes to the district court of straight to the circuit court. I am not sure if rare is accurate (1 in 150), but highly unusual, very very highly. This project is not some virgin project or experimental thing, the ACOE knows what it is doing, has permitted p0laces basically like this in 50 other locales. The opponents will all scream and cry but this is unique this area on god's green earth....they will always scream there is a mouse in the corner, what shall we do anything to stop a project, anything on earth they wills scream and cry and moan that it is an emergency this one, forget the last 300 they have screamed about, this one truly is different. TC would be able to name a couple I am sure. He truly is world class expert or national expert. Very impressed with him. The appeal of the ROD is a whole kettle of fish or worms but that should not sway anybody here, if you have your money in the stock market. The opponents, who are the most sleazy kind of lawyers you can imagine, truly sickies with law licenses, know an ROD is coming and that their chances of success on appeal, other than delay, is fairly close to slim and none with an honest appellate court. the key thing is rule one of any appeal in this area of the law is that the court must defer to the expertise of the fact finder, in this case the ACOE, a very big deference I might add, since the ACOE is hte expert, not these judges, they are supposed to review the process to see if the expert acted rationally and logically, they are not supposed to second guess them, this is an established principle of review, The judge or judges know this and they know the acoe's expertise and effort here.

TC is as good as it gets, has the background nationally and in alaska to prove it.

still remember guys, this is the stock market, not bonds, there is risk for sure and the court system is the court systme. their goal is to win or if they lose to delay and delay.
