Here's my wild speculation. Between the Adcom 2013 and the judicial proceedings it's obvious to me somebody really does not want this drug on the market. If there is no patent holder who's going to advertise the drug? If the drug is not advertised who's going to buy it. They may buy it eventually but there's going to be a big delay and maybe people just forget it even exists. Someone has succeeded gumming up the works and this is just the icing on the cake. Pharma would rather keep their Statin poison market share than something like this.
