From today's AMRN PR...QUOTE..."Amarin is currently reviewing its legal options and within 30 days expects to file a petition for an en banc review of the current panel decision by the full panel of 12 active judges at the U.S. Court of Appeals for the Federal Circuit."

Questions...
1. Is the CAFC OK with the weighing of negative vs.positive S.C. becoming case law?...
2. What effect does this have on future analyses of S.C?

Judge Du made it clear in her own words that this "weighing" was instrumental in her decision.
