Here’s what’s going to happen:
1)The cases where NOT consolidated
2)Both Amarin and ANDA are forced to brief 500 mg ANDA case in next two weeks
3)CAFC is forcing parties to negotiate settlement in next two weeks

Amarin has the upper hand despite the Appeal loss; look at the Orange Book. ANDA can not launch without litigation for damages; damages that could bankrupt Hikma & Ready’s. New OB patent is DIRECT infringement.

ANDA can not chance off-label use of generic drug, they are liable for R-I damages.

Again, Amarin has the upper hand in these negotiations.

Settlement by the end of September.
