Dan, my understanding is that on matters of fact Judge Du was deemed to have established that and it would only be overturned on a procedural issue. But on the decision itself that will be evaluated de nova, so the 3 panel court will weigh that on it's merits.

I would think that from the total lack of questions on the factual issue of Mori being the prima facia obviousness, that is likely dead. Needed to argue that better at trial.

The key question is the secondary considerations outweighing the prima facia Mori evidence. On that the panel does not need to see a mistake, they just have to form a different option.

I doubt they just ignore it because they are lazy.
