Finally got to listen to the OA. After reading all the posts today, and that real-time tweeted Twitter feed, I was expecting it to be far far worse for AMRN. I think Singer did a very good job at pointing out what was wrong with this DC's decision and how this case is different from Novo. I think it'll go 2-1 (Dyk against) to send it back to the DC with instructions to consider the SC without weighing them against each other. No need for an opinion to do that so it could happen as soon as 2-3 weeks. It's also possible that Dyk changes his mind after reviewing the briefs, because based on his questions he seemed to think that weighing SC against the prima facie finding was fine in Novo, but that's isn't the error here. Here it is the weighing of the SC against each other. So I'm saying 2-1 or 3-0 remand.
