Implications of what happens tomorrow (if God forbid Affirmed):

a) Amarin will discontinue any and all efforts in USA. This will lead to reduction or probably the end of the sales force. All 800 sales employees will be fired. This will affect 800 families directly.

b) Amarin will stop all advertising/promotional activities/marketing in USA.This will result in hundreds of thousands if not millions of CVD cases that could have been stopped because Vascepa would remain an unknown blockbuster life saving drug.

c) New precedents (case law) will have been written in patent litigation where Prima facie can be declared without even considering objective indicia and weighing of objective indicia will be allowed against each other and burden-shifting will be allowed on the plaintiff to 'save' the patents. All these will result in new written history for patents and related law indicating to all new inventors especially in Bio-Pharma that whatever you are discovering today, spending millions and billions doing trials etc. can all be negated and nulled after a few years if you are successful because of ONE DISTRICT COURT JUDGE who did not even consider the evidence correctly. This will result in several things including no trust in the USPTO, no trust in the government to protect innovation and no trust in patent protection.

The decision that will be made here in the appeals court will have huge implications both financially for Amarin and its shareholders, its current and future patients' safety and health, patent law and protection and innovation and inventions. I hope the CAFC judges understand what they are going to rule on.
