Not even close to being correct. The CAFC will slaughter both attorneys at oral arguments... Both parties held cards back from CAFC, cards that can be played at a later date the moots CAFC's limited court time. CAFC Panel will be hostile towards both parties...I'd be surprised if either party gets a coherent argument out. Perhaps that's why the CAFC changed panel assignments...to embarrass both parties for hours at the end of the day...
