My mistake. I was not aware of the second docket number appeal 20-2108. Hat tip to Eight for bringing that to my attention with his post.

My analysis is that the main appeal (20-1723, 1901) is moving forward with oral argument on September 2. The second appeal (20-2108) is stayed pending disposition of the main appeal. A stay means that the appeal is stopped in its tracks, and nothing happens in that case.

Nothing will happen in that case until 14 days after disposition of the main appeal, when the parties are ordered to inform the Federal Circuit what they want to do with it. They may agree to proceed with it under a briefing schedule, dismiss the appeal, or enter a consent order agreeing that it is bound by the decision in the main appeal.
