Regardless of the terminology, why are you so certain that the German tax authority is not correct?

It does not matter who made a profit. A dividend received would still generally be reported income (though they might not owe any actual cash given the loss).

And you can not escape such as tax by closing the foreign subsidy and swallowing the assets (or forgiving an owed amount). Else all these huge multinationals could always have repatriated their oversees business just be shuttering the subsidy.

I do not claim to know tax law nearly enough to weigh in on who is right. But neither do you or Senti. Yet both of you mock the German tax authority.

In LP we trust is not a good investment model.
