I don't think it's unusual for judges to copy/paste sections of both party's documents in their decision - why reinvent the wheel? Ever try to submit a paper in high school or college where you plagiarized stuff straight out of an encyclopedia or some other published work? It's nearly impossible to change the language and words sufficiently to fool a computer program into thinking those are your own words - that software uses pattern matching and easily spots cheaters. Schools will also scan classwork papers and add them to the database so down the road some kid can't come along and try to submit his older brother's paper as his own.
