Irish., I agree. I've said many times, this case is unlike any other drug patent loss case. We have two Gorillas piling on a small evolving biotech. Of all the disturbing revelations, I was most upset thinking that Amarin's story was lost in the midst of all the technical jargon this case seemed to be reduced to. Du's handling of the case and ruling, fed into my deepest fear, that the court doesn't consider the dispositions of the parties, when in fact IMO, it should absolutely.

My concern disapated, when I read Singer's briefs, and most of all, when I read Aimed Alliance's Amicus. Amarin's story and the stakes at large have been laid to bare. IMO, Du was an anomaly. The Judges will see right through the disproportionate disparity between the parties. They will see the case as a David vs two Goliaths. Justice won't be reduced to hindsight underpowered wrong population studies. I'm telling you, Generics will not enjoy the latitude they had with DU. They're in the big leagues now, and the Judges won't get caught looking, and Generics' have no shot at stealing base.
