If there is anyone here really good weighing in on the patent discussion its Investor2014. About a year ago there was a lengthy discussion about it.
Im to uninformed to fully answer your question. I have done different types of IP trials but I do lack enough technical 2-71 and 3-71 knowledge.

I personally have some concerns about Anavex patent for the mid-term.
The key patents for A2-73 have expired, and the follow-on patents would likely not survive a challenge. This is unfortunate.

Finally, what are the ground rules for foreign patents? Is there a central EU patent office, or is it by each country?




The same in the US it has to be technically innovative, nonexisting, and not been made public yet. Each country within the EU has its own patent office and there is an EU patent office in Bilbao Spain for the whole of the EU. If a patent has been recognized in one country the invention is automatically protected in other all participating countries world wide including China! for a period of one year upon registration.
Why register in one's own country and not in Bilbao or vice versa. Well for Europe if the invention is registered in a EU country then the invention is automatically protected in the other EU countries for 2 years. If WW or in EU the inventor sticks with his her country or EU only then the invention is only protected in that country or only the EU.
