Raf-no, the motion made to consolidate was made in front of the "motion panel" and they are saying in THEIR Order to send the Order to the Merit Panel=the judges that will hear the appeal.

Typically the easy pre hearing motions are heard by "motion panels" and they send their result to the "merit panel" who hear the case.

If pre hearing motions are complex it is heard together with appeal by merit panel.
