It's important not to lose sight of the optics of this case. The inequities between the parties is staggering. It's really happening! Two collosal Generics are embroiled in a blood lust to steel the life blood of a small company. The entire future of innovation is at stake. It's truly a classic case of good vs evil, and somehow, this all fell deafly on Du's ears. But make no mistake about it, three seasoned Judges won't fail to understand the implications of their responsibilities. It's easy to conclude that Du was biased. She was immune from considering the consequences of her decisions. In fact, her life view was on full display, when she weighed obviousness and secondary conditions against each other, she didn't stop there! Her most eggregious act was shifting the burden on the Plaintiffs to prove the secondary conditions "outweighed" her predetermined conclusion that they were "weak."

No matter how patent unfriendly any of these Judges may be, her final act was "unlawful"! It's analogous to stacking the deck. It's perverting the law and the facts to justify an outcome. Three Judges will not allow themselves to be entrapped in Du's failed methodology. Period! Full stop!
