If the pharmacist never sees the indication, how is the insurance company supposed to know?

Partial answer: the only way insurance would know is during a "peer reviewed" authorization, in which the patient's doctor/nurse haggles for coverage with the insurance provider's MD. If the details of the decision are recorded, that may serve as proof the insurance company knew it was for R-I and generic coverage therefore would induce infringement. Instead of X% of usage infringing, the above would be a concrete confirmed instance of infringement.
