Are you thinking the pharmacist or insurance company are agents of the doctor? As a layman I'm unaware of any legal duty for a doctor to write DAW just so other non-agent actors avoid infringement. Specific contexts like private practice or prescribing docs in executive positions might be exceptions by virtue of employment relationship.
