Why wasn't the Marine trial on it's "own merits", used to bolster the weight of secondary considerations? The requirement of running a trial is in and of itsself, a directive, that requires success to overcome skepticism. Amarin's successful undertaking speaks directly to Du's claim, as she described s.c. as "weak." I've heard "praise" and "skepticism" used to describe the reflections of Amarin's peers at the time of the invention. However, doesn't a mandate to run a trial "successfully," "prove" nonobviousness?

If running upwards of millions, if not billion dollar trials to prove nonobviousness is considered insignificant, Generics can strategically wait until the day after TLD and sue for "obviousness." Really?
