I think the reason that Du put in weighting of SCs is because there are case law out there such that unmet need and commercial success had overcome obviousness, i.e., it's not an unforced error from Du. Does anybody recall any such case law (Samsung Vs Apple?)? If there were case law, then our case is quite strong (90%?) since we know weighting of SC is clearly erroneous. The only way for H&R to win is although weighting of SC is erroneous but either unmet need or commercial success get downgraded by the panel.
